APPENDIX “E”
TERMS AND CONDITIONS MATTRESS
Your Obligations:
1.
The
consumer must register their warranty within TEN (10) days of purchase of the
mattress protector in order for said warranty to be valid. All warranty registrations must be done online, registration by mail or by phone is not a valid
option.
2.
The
MATTRESS Protector must be purchased at the same time
and at the same location as the new mattress. Said purchase date and location must be reflected on the customer’s
retail proof of purchase.
3.
You
must follow the care & maintenance guidelines of the MATTRESS protector and
the mattress.
4.
You
must report any stains to THE PLAN ADMINISTRATOR within five (5) days of the
date the stain occurred IF YOU ARE UNABLE TO REMOVE THE COVERED STAIN. Failure
to comply will void this warranty. CALL 1-800-663-1708. FOR FASTER SERVICE
PLEASE HAVE YOUR CUSTOMER RECEIPT AVAILABLE.
5.
You
must retain this Limited warranty certificate and your original Bill of Sale
for both the Mattress protector and Mattress and provide this information to THE
PLAN ADMINISTRATOR upon request. The
Mattress Protector and mattress must be purchased at the same time otherwise
the limited warranty will be void.
6.
The
term Plan refers to the BedCare™ Plan, and the Plan Owner refers to the
purchaser of said Plan
1.0
Comfort Exchange Guarantee
Coverage under this Plan provides for a one
(1) time replacement mattress under the comfort exchange guarantee subject to
the below conditions. Should the retailer
offer a comfort guarantee this Plan will apply to the covered mattress for
ninety (90) days after the expiry of the retailer’s comfort guarantee subject
to the terms herein, should the retailer not offer a comfort guarantee,
coverage under this plan will apply to the covered mattress for ninety (90)
days from the date of purchase subject to the terms herein:
A.
Your mattress must have
been delivered and used by you for a minimum of thirty (30) days and your
request for replacement must be made within ninety (90) days from the date of
purchase or within ninety (90) days of the expiry of the retailer’s sleep
comfort guarantee.
B.
Your mattress must be
exchanged by the same retailer and at the same location as the original
mattress was purchased for a replacement mattress that is the same size and of
equal or greater value (not including taxes, delivery, or other charges) as the
original mattress. The Plan
Administrator’s liability under this Plan will be limited to the original
purchase price of the mattress, any costs over an above the original purchase price will be the responsibility of the Plan Owner.
C.
In the event that the
original mattress and the replacement mattress use the same foundation, only
the mattress will be exchanged.
D.
To be eligible for a
comfort exchange the original mattress must be in its original purchase
condition without any stains, marks, or damage of any kind, and must be
available for inspection at the Plan Administrator’s discretion.
E.
The Plan Owner is
responsible for payment of any delivery, pick-up or administration costs to facilitate
the comfort exchange under this Plan unless covered by the selling retailer.
2.0
BedCare™ Plan for Mattresses
Coverage under this Plan will be applicable for the term listed below
A.
Subject to the terms herein coverage under this Plan with regards to
stain protection will be in effect for a period of ten (10) years from the date
of purchase of the Mattress Protector.
B.
Subject to the terms herein coverage under this Plan against odours will be in effect for three (3) years from the date
of purchase of the Mattress Protector.
C.
Subject to the terms herein coverage under this Plan against rips,
tears, punctures, and burns will be in effect for three (3) years from the date
of purchase of the Mattress Protector.
Should the
mattress you purchased at the same time as the Mattress Protector become
stained from any food or drink normally consumed, or any bodily fluids during
the warranty term the Plan Administrator will service the stained area(s) of
the mattress providing the Mattress Protector was in place at the time the
stain occurred. The service will include providing the
customer with professional cleaning remedies and/or products designed for
effective spot removal. If the stain persists the Plan Administrator will have the mattress professionally
cleaned at no charge to the customer.
The Plan also provides for protection against accidental rips, tears,
and burns. Should a covered mattress be
ripped, torn or burned subject to the terms below, the Plan Administrator will
arrange for an inspection and a repair of the covered mattress.
Should the Plan Administrator be unable to affect a repair subject to
the terms herein or to remove a stain, the Plan Administrator will offer a
replacement to the Plan Owner subject to the following conditions:
A.
Your mattress must be
exchanged by the same retailer and at the same location as the original
mattress was purchased for a replacement mattress that is the same size and of
equal or greater value (not including taxes, delivery, or other charges) as the
original mattress. The Plan Administrator’s liability under this Plan will be
limited to the original purchase price of the mattress, any costs over an above the original purchase price will be the responsibility
of the Plan Owner.
B.
In the event that the
original mattress and the replacement mattress use the same foundation, only
the mattress will be exchanged.
C.
The Plan Owner is
responsible for payment of any delivery, pick-up or administration costs to
facilitate replacement under this Plan unless covered by the selling retailer.
D.
Provision of a
replacement credit or of a replacement for a covered mattress will fulfill the
Plan Administrator’s obligations under this warranty.
Warranty exclusions: This Limited Warranty does not cover:
A.
Stains or material damage caused by defect in factory materials or
workmanship, or defect apparent at the time of delivery;
B.
Should the covered Product have a stain that is not warrantable the Plan
Administrator reserves the right to refuse service for rips, tears, punctures
and burns;
C.
Manufacturer recalls;
D.
Stains or damage to the material caused by: orange drinks of any nature,
felt tip markers;
E.
The owner’s failure to use reasonable caution and care to protect the
Mattress Protector and/or mattress;
F.
Continued abuse or neglect of the Mattress Protector and or mattress;
G.
This Plan excludes any damages resulting from infestation of any kind.
H.
Stains or damage as a result of failure to follow the manufacturer’s
instructions for care of the item;
I.
The BedCare™ Plan does not include coverage for
stains to the side of a covered mattress;
J.
Stains on the Mattress resulting
from: dye; bleach, paint, acid or corrosive products; chewing gum; buildup of
perspiration and body or hair oils; fading, soiling or damage caused by pets
(other than bodily fluids); and use of non-approved cleaning products, nail
polish, nail polish remover;
K.
Refusal to permit our inspection of the mattress or Mattress Protector;
L.
Repairs or cleaning carried out by anyone other than the Plan
Administrator’s authorized agent;
M.
Use of item(s) in public areas, rental or commercial areas, or for any
purpose not intended for such item;
N.
Acts of God, weather related damage, natural disaster, war or other
hostilities of any kind, fraud or intentional acts arising from illegal
activity;
O.
Damage covered by any other insurance policy, warranty, or other;
P.
Fading or any colour variations to the
mattress;
Q.
Wear and tear;
R.
Shipping costs for reason of fault verification are the Plan Owner’s responsibility;
S.
Products used for commercial purposes;
T.
Norm
al soiling; stains of unknown origin; accumulation or buildup of stains
or soil;
U.
Mattress Protectors or mattresses in transit or storage;
V.
X coded and non-colorfast fabrics;
W.
Unauthorized repairs by others;
X.
Stains or damage not specifically listed as being covered;
Y.
If service under the
Plan is provided on-site at your location, a person who has reached the legal
age of majority must be present at all times during the service call. Should a
unit covered under this Plan require service for a warrantable defect, on site service will only be offered for entitled products
within an 80km radius of an authorized service centre. In the case where
a product falls outside of this designated radius, it will be the sole
responsibility of the Plan Owner to arrange for transportation of the unit to
an authorized service centre at their own cost;
Z.
The Plan requires that
the Mattress Protector be in position and used in accordance with manufacturer
guidelines in order to make a claim under this Plan. Should the Mattress Protector not be in
position, coverage under this Plan will not apply.
3.0 Additional
Conditions:
1.
The Plan Administrator and all
affiliated companies shall be released from all liability due to: (i)
damage to the product, replacement of the product or injury to any person that
is not due to the fault of BedCare™, (ii) indirect,
consequential, or incidental damages (including damages for lost profits,
business interruption and the like).
2.
Losses are limited to the current
value of the product and will not exceed the original retail value of the item
for which the Mattress Protector Warranty is purchased.
3.
If no defect is found or the repairs
are denied by the Plan Administrator based on the terms and conditions of this
Limited Warranty, the owner will be responsible for all costs incurred.
4.
This Limited Warranty is
non-transferable to a subsequent owner and will not be renewed upon expiration
of the coverage term described herein.
5.
The Plan Administrator reserves the
right to replace the product with a manufacturer refurbished product at its
sole discretion.
6.
Coverage under this plan is secondary
to any existing warranty, including but not limited to any manufacturer
warranty, dealer warranty, or distributor warranty.
